Terms and Conditions
1. Registration and Eligibility

All participants must register prior to bidding, providing accurate identification and contact information.

The company reserves the right to approve or deny registration at its discretion.

For motor vehicle auctions, sellers must register in compliance with Nebraska Revised Statutes § 60-1417.02, including providing necessary documentation and notarized forms.
2. Auction Formats
-
Live Auctions: Conducted in person at designated venues.

Online Auctions: Conducted exclusively through our online platform.
-
Simulcast Auctions: Conducted simultaneously in person and online, allowing remote participation.
3. Bidding Process

All bids are final and binding.

The auctioneer reserves the right to accept or reject any bid and to determine the bidding increments.

In the event of a dispute, the auctioneer’s decision shall be final.

Auctions are conducted with reserve unless explicitly stated otherwise, in accordance with Neb. U.C.C. § 2-328.
4. Payment Terms

Successful bidders must make full payment the auction’s conclusion within the number of days specifically outlined for each auction.

Accepted payment methods include Cash, Credit Card, Debit Card, Paypal, Cashiers Check.

A buyer’s premium of 3% will be added to the final bid price.
- Additional fees apply when using Credit and Debit Card.
5. Item Descriptions and Warranties

All items are sold “as is,” with no warranties or guarantees, either expressed or implied.

Descriptions and images are provided for informational purposes only and may not accurately represent the item’s condition.

Buyers are encouraged to inspect items prior to bidding.
6. Appraisal Services
-
Appraisal reports are prepared based on the appraiser’s professional opinion and available information.

The company does not guarantee that appraised values will be realized at auction or through private sale.

Clients agree to indemnify and hold harmless the company from any claims arising from the use of appraisal reports.
7. Sales Tax

All auction and consignment sales are considered retail sales and are subject to Nebraska sales tax, unless an exemption applies.

The auctioneer is responsible for collecting and remitting sales tax in accordance with 316 Neb. Admin. Code, ch. 1, § 034.
8. Real Estate Auctions

Auctioneers conducting real estate sales must comply with the Nebraska Real Estate License Act.

Successful bidders are required to sign a purchase agreement and provide an earnest deposit as specified in the auction terms.
9. Limitation of Liability

The company’s liability for any claim related to auction or appraisal services is limited to the amount paid by the client for those services.

The company is not liable for any indirect, incidental, or consequential damages.
10. Governing Law
These terms and conditions are governed by the laws of the State of Nebraska, without regard to its conflict of law principles.
11. Amendments

The company reserves the right to modify these terms and conditions at any time.

Participants will be notified of any changes prior to their taking effect.
